Affiliate Program Agreement
PSMONEY AFFILIATE AGREEMENT/TERMS AND CONDITIONS
PLEASE READ THIS DOCUMENT AND PRINT FOR FUTURE REFERENCE
To join the PSMONEY Affiliate Network, you must accept and agree to these terms and conditions without modification. If you do not agree with these terms and conditions, or cannot legally do so, you should not join the PSMONEY affiliate network. Please direct any inquiries to affiliates@psmoney.com
1. Definitions
1.1 “PSMONEY”, “PSMONEY.COM”, “WE”, “US”, all refer to PSMONEY LLC (Maryland)
1.2 “YOU”, “AFFILATE”, “YOUR”, all refer to the individual or organization that has agreed to promote PSMONEY for commissions paid out based upon signups at the website PSMONEY.COM
2. Terms and Conditions
2.1 In order to join the PSMONEY Affiliate Network you must complete the registration form located at http://www.psmoney.com/aff_register.php
2.2 You must provide true and accurate information at time of sign up. Additionally, all reasonable information requested by PSMONEY must be provided. If any information given is inaccurate it may cause the delay or retention of payments.
2.3 It is the sole responsibility of you to ensure that all applicable laws are followed while joining, promoting, and accepting payment from PSMONEY.COM
2.4 PSMONEY reserves the right to reject your affiliate application without providing reason.
2.5 You will, at your own expense, market to potential customers of PSMONEY. You will be solely responsible for the content and manner of your marketing activities. Any and all marketing activities conducted by you must be lawful and professional under any applicable laws. You will not actively target your marketing to any person(s) who are less than 18 years of age.
2.6 The PSMONEY Affiliate network is intended for your direct participation. You shall not open Affiliate Accounts on behalf of other third parties. Affiliate Accounts cannot be transferred from one party to another without express approval from PSMONEY. To transfer an Affliate Account one must go through PSMONEY. We reserve the right to accept or reject any such requests without any reason.
3. Payment, Earnings, and Reports
3.1 All affiliate reports that track earning will be made available through the PSMONEY.COM website.
3.2 All affiliate payouts will be sent within 20 days of the end of the month. Any affiliate payouts not totaling more than $50 USD will be carried over into the following month. Payment will then be made following the period when the affiliate income is equal to or greater than $50 USD.
3.3 Any traffic that is deemed fraudulent by PSMONEY will result in the withholding of some or all of the affiliate income.
3.4 PSMONEY reserves the right to change the affiliate payout structure at any time. Such changes will be sent in writing via e-mail to the affiliate using the address provided on the sign up page.
4. Terms and termination
4.1 This agreement shall be effective when you accept these terms on the Affiliate Sign Up Page and continues until terminated in accordance with the terms of this agreement.
4.2 You may terminate this Agreement, with our without case, immediately upon written notice to PSMONEY. This written notice is to be sent via e-mail to affiliates@psmoney.com.
4.3 We may terminate this Agreement, with or without cause at any time. Notice of such termination is to be sent via e-mail to the address specified at time of sign-up.
4.4 Termination of the Agreement will end your participation in the entire PSMONEY Affiliate Network and revocation of all privileges and licenses granted hereunder.
5. Liabilities
5.1 WE DO NOT WARRANT THAT OUR SYSTEM, NETWORK, SOFTWARE OR HARDWARE (OR THAT PROVIDED TO US BY THIRD PARTIES) WILL BE ERROR-FREE OR UNINTERRUPTED. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE QUALITY, MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE OR SUITABILITY OF OUR SYSTEM, NETWORK, SOFTWARE OR HARDWARE (OR THAT PROVIDED TO US BY THIRD PARTIES). WE (OR OUR PROVIDERS OR UNDERLYING VENDORS) ARE NOT REQUIRED TO MAINTAIN REDUNDANT SYSTEM(S), NETWORK, AND SOFTWARE OR HARDWARE.
5.2 We may, in our sole discretion, use any available means to block, restrict, remove or discount from your tracker certain players and/or Affiliates so as to reduce the number of fraudulent, unprofitable transactions or for any reason. We do not guarantee, represent or warrant the consistent application and/or success of any fraud prevention.
5.3 Liability Limitations. Our obligations under this Agreement do not constitute personal obligations of the owners or employees of PSMONEY.COM. Any liability arising under this Agreement will be satisfied solely from the revenues generated hereunder. Our liability is limited to direct damages, and in no event will we be liable for any indirect, special, incidental, consequential or punitive loss, injury or damage of any kind (regardless of whether we have been advised of the possibility of such loss).
5.4 Affiliate shall defend, indemnify, and hold our Clients, their directors, officers, employees, and representatives harmless from and against any and all liabilities, losses, damages, and costs, including reasonable attorney's fees, resulting from, arising out of, or in any way connected with (a) any breach of warranty, representation, or agreement contained in this Agreement, (b) the performance of your duties and obligations under this Agreement, (c) your negligence or (d) any injury caused directly or indirectly by your negligent or intentional acts or omissions, or the unauthorized use of our banners and link or this Affiliate Program.
6. Independent Investigation
6.1 YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF MARKETING THE WEBSITE AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.
7. Miscellaneous
7.1 All notices pertaining to this Agreement will be given by email as follows: to us at affiliates@fulltiltpoker.com and, to you at address provided on the Affiliate Sign up Form (or as subsequently updated by you to us in the event of change).
7.2 There is no relationship of exclusivity, joint venture, employment, or franchise between you or us under this Agreement. Neither party has the authority to bind the other (including the making of any representation or warranty, the assumption of any obligation or liability and/or the exercise of any right or power), except as expressly provided in this Agreement.
7.3 THIS AGREEMENT IS NON-EXCLUSIVE. You understand that we may at any time enter into marketing terms with other Affiliates on the same or different terms as those provided to you herein and that such Affiliates may be similar, and even competitive, to you. You understand that we may re-direct traffic and users from our site to any other website that we deem appropriate in our sole discretion, without any additional compensation to you.
You expressly agree to the terms and conditions of this Agreement by submitting the Affiliate Sign up Form.
